The 2018 Farm Bill dramatically changed the Industrial Hemp and the Hemp derived CBD industry. Hemp is big business and on track to infiltrate all aspects of the retail market.
Although the Farm Bill loosened up restrictions, much legal grey area for Hemp producers still exists, creating many unanswered questions. This especially rings true for transportation of Hemp and more importantly, transportation across state lines.
Understanding Hemp Laws Between States
The 2018 Farm Bill allows Hemp production in States with a USDA approved plan or follow a Federal plan. However, to date, the USDA has yet to issue a Federal plan or approve any individual State’s production plans.
Currently, 41 States have legalized Industrial Hemp, to varying degrees. Each State has mandated their own set of Rules and Regulations regarding possession and transportation of Hemp. No clear guidelines have been provided by the Federal government thus making the transportation of Hemp incredibly difficult on both the Hemp industry and transporters.
The lack of clarity around the legality of transport make finding drivers wiling to move Hemp increasingly difficult. Many are just not willing to open themselves to the probability of confrontations with State Law Enforcement.
Additionally, many drivers and Transportation Companies have not considered procuring the correct insurance. In light of all the unclarity, few Transportation Companies are currently willing to insure Hemp products and its safe transportation.
